Welcome to US Sports Club Insurance (USSCI), the leading provider of sports registration insurance for coaches, parents, athletes, clubs, leagues, associations, and governing bodies. These “Terms of Use” constitute a legal agreement between you (the user of our services) and US Sports Club Insurance, LLC, a Texas limited liability company (“USSCI”). These Terms apply to all USSCI websites, mobile applications, software platforms, and any social media accounts that reference these Terms of Use (collectively referred to as “Sites and Services”). Our Sites and Services include USSCI, Sports Fee Insurance, sportsfee.us, and any other integrated software platforms. Unless otherwise stated on the platform, these Terms apply universally. The Sites and Services are the property of USSCI and are governed by the following terms and conditions. Please read these Terms carefully. By accessing or using our Sites and Services, you agree to comply with and be bound by these Terms of Use. If you do not agree, you must discontinue access and use of the Sites and Services.

  1. Use of Our Sites and Services.
    USSCI owns and operates the Sites and Services. Under these Terms, we grant you a non-exclusive, limited, non-transferable, revocable license to use the Sites and Services solely for your personal, non-commercial use. You agree not to, and not to permit any third party to, modify, copy, reverse engineer, create derivative works from, or attempt to access the source code of the Sites or Services. You are also prohibited from selling, assigning, sublicensing, or transferring any rights to the Sites or Services. USSCI retains all rights not expressly granted herein. Your access and use of the Sites and Services are valuable consideration, and by accepting these Terms, you acknowledge and agree to this consideration.

  2. Term and Termination.
    Your agreement to these Terms of Use begins upon your initial access or use of the Sites and Services and continues until your account is closed, or USSCI terminates your access. If your account or these Terms are terminated for any reason, (a) the rights granted under these Terms will end, (b) you must immediately cease using the Sites and Services, (c) USSCI may delete your account data, and (d) USSCI will not be liable for any damages, compensation, or reimbursement related to the termination or deletion of account data. Sections of these Terms that survive termination include, but are not limited to, sections on User Content, Code of Conduct, Intellectual Property, Warranties, Limitation of Liability, Indemnification, and Arbitration.

  3. Account Registration.
    To use certain services through the registration platform you are accessing, you may be required to create a USSCI Account. You agree to provide true, accurate, current, and complete information when setting up your account and acknowledge that such information will be used to deliver services to you. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur within your account. In case of a dispute over account ownership, USSCI reserves the right to determine the rightful owner and may suspend or terminate the account if necessary. USSCI’s decision in such disputes is final and binding on all parties.

Policy Overview - Event Cancellation TEAM Coverage

Coverage Plan Summary

US Sports Clubs Insurance administers an insurance program on behalf of your Sports Organization. Your Sports Organization may be a member of the Sports Club Families of America RPG and is an insured under the policy. The Designated Participants are Loss Payees on the Policy.

Conditions

Coverage does not apply if the Sports Organization or the Loss Payee had any knowledge, fact, or condition, which could reasonably lead to or cause a Cancellation, Abandonment, Disruption, or Rescheduling of the Sports Event prior to the effective date of the policy.

Any person who commits a fraudulent insurance act is guilty of a crime and may be subject to restitution, fines, and confinement in prison. A fraudulent insurance act means an act committed by any person who, knowingly and with intent to defraud, presents, causes to be presented, or prepares with knowledge or belief that it will be presented to, or by an insurer, purported insurer, or insurance agent or broker, any written statement as part of, or in support of, an application for insurance, or the rating of an insurance policy, or a claim for payment or other benefit under an insurance policy, which such person knows to contain materially false information concerning any material fact thereto; or conceals, for the purpose of misleading, information concerning any fact material thereto.

Plan Description for Event Cancellation

Coverage for damages arising out of the Cancellation, Abandonment, Disruption, or Rescheduling of the scheduled Sports Event. Claims will be adjusted based on games played vs games guaranteed. A game is considered played if a score is entered.

Definitions

  • Abandonment/Abandoned means the inability to complete the Sports Event once commenced.
  • Approved Sports Plan means assumed or written registration documents by and between a Sports Organization, the Insured, and the Loss Payee that exists in order for the Loss Payee to participate in a specific Sports Event.
  • Cancellation/Cancelled means the inability to commence with the Sports Event.
  • Communicable Disease means an illness caused by a pathogen and transmitted from an infected person or animal to another person or animal.
  • Company means the insurance company that issued this policy, as shown in the Declarations.
  • Damages means non-refundable registration fees that are required to be paid in order for a Loss Payee to be a participant in a Sports Event. Damages are reduced by any credits issued to the Loss Payee for future events by the same event organizer.
  • Insured means the entities designated in the Declarations Page and attached to this policy by Certificate of Insurance.
  • Loss Payee means the Designated Participant listed on a Certificate of Insurance that is attached to this policy.
  • Master Policy Period means the period shown on the master policy Declarations.
  • Named Insured means the Risk Purchasing Group (RPG) listed on the Declarations Page.
  • National Mourning means a period of National Mourning officially declared by the Government of the Country where the Sports Event is due to take place.
  • Participants means players, athletes, or other sports persons whose performance is critical to the successful fulfillment of the Sports Event.
  • Policy means this policy form, the Declarations, the Certificate of Insurance, and any endorsement to the policy issued by us.
  • Policy Period means the date from which this policy commences (as stated on the Certificate of Insurance) and the date in which all coverage under this policy ends (as stated on the Certificate of Insurance).
  • Rescheduling/Rescheduled means the necessary removal of the Sports Event to another Venue(s) or the necessary postponement, delay, or suspension of the Sports Event for a period not to exceed 60 days.
  • Sports Event means the Sports Event as stated in the Declarations and Certificate of Insurance held at the Venue.
  • Sports Event Period means the date from when the Sports Event commences (as stated in the Declarations and Certificate of Insurance) to the date in which the Sports Event ends (as stated in the Declarations and Certificate of Insurance).
  • Terrorism means an unlawful act, including but not limited to the use of force or violence, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organization(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.
  • Threat of Terrorism means information received by local or national governmental authorities relating to Terrorism that poses or appears to pose a real risk of physical loss or damage or actual bodily injury or death if the Sports Event were to proceed, whether or not such risk subsequently proves to have been real or hoax.
  • Venue means the place(s), building(s) or other structure(s) stated in the Declarations and the Certificate of Insurance where the Sports Event is to be held.
  • Sports Organization(s) means the entities as listed on a Certificate of Insurance that is attached to this policy.

Exclusions

This policy does not provide any coverage for damages directly or indirectly arising out of, contributed to by, or resulting from:

  • Non-appearance of any person(s) or groups of persons.
  • Your lack of care, diligence or prudent behavior, the result of which would increase the risk and/or likelihood of a loss under this policy.
  • Any Approved Sports Plan dispute by you or any Participant.
  • Alterations or variances of the Sports Event without our prior written approval.
  • Adverse weather, unless such adverse weather, in the opinion of the Sports Event umpire, referee, venue owner, custodian of venue, or other similar official, makes the Sports Event dangerous or impossible to proceed or to continue.
  • Any work being carried out by builders or other contractors which renders the venue or its facilities unusable in whole or in part.
  • Your failure to observe and comply with the requirements of any law, ordinance, court or regulatory body of whatever jurisdiction.
  • Your failure to make all necessary arrangements for the successful fulfillment of the Sports Event (including, but not limited to, sufficient travel time, setup, and/or rehearsal time).
  • Your failure to ensure that all necessary arrangements with You are made and confirmed in writing and that all necessary authorizations (including licenses, permits, visas, copyright, and patents) are obtained in a timely manner and valid for the Sports Event Period.
  • Fraud, concealment, or intentional misstatement of information or a claim.
  • Actual or threatened war, invasion, hostilities, civil war, rebellion, or other similar occurrences.
  • Civil commotion assuming the proportions of or amounting to a popular uprising, riot, or martial law.
  • Seizure or destruction under quarantine or customs regulations.
  • Radiation or radioactive contamination.
  • Seepage, pollution, or contamination.
  • The withdrawal, insufficiency, or lack of finance.
  • Lack of receipts, sales, or profits.
  • The malicious use of pathogenic or poisonous materials.
  • Any Communicable Disease or virus declared by WHO, CDC, or other governmental authority as a pandemic or Public Health Emergency.
  • The fear or threat (actual or perceived) of any Communicable Disease or virus.
  • National Mourning, unless it is due to the death of the President of the United States or a person below 65 years of age and occurs within 7 days of the Sports Event.
  • Government shutdown ordered by any Federal, State, County, City, or local Government.
  • The withdrawal of funding by any government entity.
  • Any act of Terrorism or Threat of Terrorism (whether actual or perceived).
  • Cyber Act or Computer System Failure.

Duties in the Event of a Claim

In the event of a claim for damages arising out of a Cancellation, Abandonment, Disruption, or Rescheduling of the Sports Event, the Insured or Loss Payee must report the claim within 60 days of the Sports Event Period by either:

  • Follow instructions and provide requested information.
  • Authorize USSCI to obtain records and other necessary information.
  • Cooperate in the investigation, defense, or settlement of the claim.
  • Assist USSCI in the enforcement of any right against any liable person or entity.

No Insured may voluntarily make a payment, assume an obligation, agree to a settlement, or incur any expense related to a claim without USSCI’s consent.

Important Notice Regarding Risk Purchasing Groups

Disclosure Pursuant to Federal Law Regarding Purchasing Groups [15 U.S.C. SEC. 3901, et seq]. The Sports Club Families of America RPG, LLC is a “Purchasing Group,” as defined under Federal law, formed to purchase liability insurance on a group basis for its Members to cover the similar or related liability exposures to which the Members of the Purchasing Group are exposed by virtue of their related, similar, or common businesses or services. Members do not share limits, and each member is provided with its own policy and/or evidence of insurance.

Policy Overview - Sports Fee Insurance

COVERAGE PLAN SUMMARY – THIS IS NOT AN INSURANCE POLICY

US Sports Clubs Insurance administers an insurance program on behalf of your Sports Organization. Your Sports Organization may be a Sports Club Families of America RPG member and is insured under the policy. You are Loss Payees on the Policy. You are not insured, but as a Loss Payee, you may benefit from the purchased Coverage Plan.

CONDITIONS

Coverage does not apply to a Season Incident that arises from a pre-existing injury, sickness, or disorder unless the Designated Athlete received a release to play from their doctor and coach prior to active participation.

Coverage does not apply if the Sports Organization, the Designated Athlete, or the Loss Payee had any knowledge, fact, or condition, which could reasonably lead to or cause a Season Incident, prior to the season effective date of this policy.

PLAN DESCRIPTIONS

MVP Plan

  • A licensed and practicing physician concludes in writing that a physical bodily injury, which occurred during the policy period, does not allow the Designated Athlete to be an active participant of the Sports Organization for the remainder of the Policy Period.
  • A licensed and practicing physician concludes in writing that a physical sickness, which occurred during the policy period, does not allow the Designated Athlete to be an active participant of the Sports Organization for the remainder of the Policy Period.
  • The Death of a Parent or Guardian that occurs during the policy period and does not allow the Designated Athlete to be an active participant of the Sports Organization between the time that the Season Incident occurred and the Season End Date.
  • The Death of a Designated Athlete.

Elite Plan

  • A licensed and practicing physician concludes in writing that a physical bodily injury, which occurred during the policy period, does not allow the Designated Athlete to be an active participant of the Sports Organization for the remainder of the Policy Period.
  • A licensed and practicing physician concludes in writing that a physical sickness, which occurred during the policy period, does not allow the Designated Athlete to be an active participant of the Sports Organization for the remainder of the Policy Period.
  • The Death of a Parent or Guardian that occurs during the policy period and does not allow the Designated Athlete to be an active participant of the Sports Organization between the time that the Season Incident occurred and the Season End Date.
  • The Death of a Designated Athlete.
  • Job relocation of Parent or Guardian (who is a W2, non-owner employee) which occurs during the policy period, takes the Designated Athlete more than 75 miles away from their previous residence, whereby the Sports Organization cannot transfer the Designated Athlete to another team, and which results in the Designated Athlete not being able to be an Active Participant of the Sports Organization between the time that the Season Incident occurred and the Season End Date.
  • Involuntary Job Loss of Parent or Guardian (who is a W2, non-owner employee) which occurs during the policy period and results in the Designated Athlete not being able to be an active participant of the Sports Organization between the time that the Season Incident occurred and the Season End Date.
  • A mental health disorder that occurs during the policy period, that does not allow the Designated Athlete to be an active participant of the Sports Organization between the time that the Season Incident occurred and the Season End Date, and which is further confirmed by a licensed psychiatrist.
  • A short-term exception.

DEFINITIONS

  • Active Participant means when a Designated Athlete practices and plays in games as part of their Sports Organization as defined in the Approved Sports Plan.
  • Approved Sports Plan means assumed or written registration documents between a Sports Organization and Parent or Guardian of a Designated Athlete that exists in order for the Designated Athlete to participate in a sport for a specific season and specific period of time.
  • Company means the insurance company that issued this policy, as shown on the Declarations page.
  • Damages means non-refundable registration fees that are required to be paid in order for a Designated Athlete to be an Active Participant in a Sports Organization.
  • Designated Athlete means the individual listed on a Certificate of Insurance, attached to this policy.
  • Insured means the entities designated in the Declarations Page and attached to this policy by Certificate of Insurance.
  • Involuntary Job Loss means a general strike, layoff, unionized labor dispute, lockout, or termination.
  • Loss Payee means the Parent or Guardian listed on a Certificate of Insurance that is attached to this policy.
  • Master Policy Period means the period shown on the master policy Declarations page.
  • Mental Health Disorder means a diagnosed illness, by a licensed psychiatrist, defined as a substantial disorder of thinking, mood, perception, orientation, or memory that grossly impairs judgment, behavior, capacity to recognize or ability to meet the ordinary demands of life.
  • Named Insured means the Risk Purchasing Group (RPG) listed on the Declarations Page.
  • Parent or Guardian means the individuals who are legally responsible for the Designated Athlete.
  • Policy means this policy form, the Declarations, the Certificate, and any endorsement to the policy issued by us.
  • Policy Period means from the Season Effective Date to the Season End Date as shown on a Certificate of Insurance attached to this policy.
  • Season Effective Date means: When the Approved Sports Plan is signed or accepted and premium for a certificate of insurance attaching to this policy is paid in full but is subject to a 15 day waiting period before coverage begins. Job relocation and involuntary job loss as described in the Elite Plan above are subject to a 30 day waiting period before coverage begins.
  • Season End Date means the day of the last organized team regular season practice, game, or as shown in the Approved Sports Plan.
  • Season Incident means an incident as defined in one of the plan descriptions above, as listed on a Certificate of Insurance that is attached to this policy.
  • Short Term Exception means when a), b), or c) of the above Elite Plan incidents occur and do not allow the Designated Athlete to be an active participant of the Sports Organization for 30 consecutive days or more, and when the date that the Season Incident occurred and the date that the Designated Athlete returns to active participation is during the policy period.
  • Sports Organization(s) means the entities as listed on a Certificate of Insurance that is attached to this policy.

EXCLUSIONS

This policy does not apply to or provide any coverage for damages:

  • That existed prior to the season effective date.
  • Resulting from a Season Incident that arises from a pre-existing injury, sickness, or disorder unless the Designated Athlete received a release to play from their doctor and coach prior to active participation.
  • When the Sports Organization, the Designated Athlete, or the Loss Payee had any knowledge, fact, or condition, which could reasonably lead to or cause a Season Incident, prior to the season effective date of this policy.
  • When the Designated Athlete is no longer able to be an active participant in the listed Sports Organization because of a Season Incident but remains an active participant in another sport during the policy period.
  • Resulting from acts committed with the intent to cause damages.
  • As a result of the abuse of alcohol or drugs.
  • As a result of engaging in extreme sports.
  • As a result of a criminal act by you.
  • As a result of an epidemic or pandemic, defined as a contagious disease that spreads rapidly and widely among the population in an area and is recognized as an epidemic or pandemic by the World Health Organization, Centers for Disease Control and Prevention, or any local, county, state, or federal governing body.
  • Relative to Involuntary Job Loss, when you: are employed by a member of your immediate family or household; quit your job or retire; are fired due to misconduct; lose your job because an employment contract ends; are seasonally employed; or keep your job, but your work hours are reduced.
  • As a result of nuclear reaction, radiation, or radioactive contamination.
  • As a result of war (declared or undeclared) or acts of war.
  • As a result of civil disorder or unrest.
  • As a result of foreign or domestic terrorism.
  • As a result of a natural disaster.
  • As a result of bankruptcy, business failure, or closure of a Sports Organization.

DUTIES IN THE EVENT OF A CLAIM

In the event of a claim for damages arising out of a Season Incident, the Insured or Loss Payee is responsible to report the Season Incident within 60 days after the Season End Date to the Company by either:

You and any other involved Insured or Loss Payee must:

  • Follow the instructions and provide the requested information at https://ussportsclubinsurance.com/contact/.
  • Authorize us to obtain records and other information as needed.
  • Cooperate with us in the investigation, defense, or settlement of the claim for damages.
  • Assist us, upon our request, in the enforcement of any right against any person or entity that may be liable to you because of damages to which this insurance may apply.

No Insured will, except at that Insured’s own cost, voluntarily make a payment, assume any obligation, agree to a settlement, or incur any expense related to a claim for damages without our consent.

CLAIMS EXAMPLES

Example 1: A Designated Athlete tears her ACL on March 12th while skiing on marked trails and a physician certifies that she will have to sit out the remainder of the season. The season effective date is January 1st and the Season End Date is June 30th (180 days). The date of loss is March 12th and there are 110 days remaining until the Season End Date. The Limit of Liability designated on the certificate of insurance is $3,000. Damages are calculated at ($3,000 / 180 days * 110 days = $1,833).

Here is a scenario of how the damages may get paid out: The Loss Payee claims that they have paid the Sports Organization $2,200 of the $3,000 fee that is due for the Designated Athlete to be an active participant for a specific season and is now claiming damages of $1,833 for not being able to finish the season. After we receive written confirmation from the Designated Athlete’s physician that confirms the Season Incident, and we receive confirmation from the Sports Organization that payment of $2,200 of the $3,000 was made, we will pay the Loss Payee damages of $1,033 ($1,833 damages less $800 owed to the Sports Organization) and the Sports Organization for damages of $800 for a total of $1,833 in damages.

Example 2: A Designated Athlete suffers a concussion on March 5th during a soccer match. The season effective date is July 1st and the Season End Date is May 31st (334 days). The date of loss is March 5th, however he was cleared by his physician and coach to return to active participation on April 19th so he missed a total of 45 days. The Limit of Liability designated on the certificate of insurance is $3,500. Damages are calculated at ($3,500 / 334 days * 45 days = $472).

Here is a scenario of how the damages may get paid out: The Loss Payee claims that they have paid the Sports Organization $3,200 of the $3,500 fee that is due for the Designated Athlete to be an active participant for a specific season and is now claiming damages of $472 for the 45 days missed. After we receive written confirmation from the Designated Athlete’s physician that confirms the Season Incident and their release back to active participation, receive confirmation of the coach’s release for active participation, and the Sports Organizations confirmation that payment of $3,200 of the $3,500 was made, we will pay the Loss Payee damages of $172 ($472 damages less $300 owed to Sports Organization) and the Sports Organization for damages of $300 for a total of $472 in damages.
